Twist, who has been out of the game since last June and is recovering from injuries suffered in a motorcycle wreck last August, testified that the character reduces his opportunities to endorse products and harms his aspirations for a post-hockey career of public speaking and sports broadcasting. Sports fans may remember McFarlane as the man who paid over $3 million for the baseball mark McGwire hit for his record 70th home run two years ago. In a published response to a fans letter, McFarlane had acknowledged that the "Twist" character was named after a player on the Quebec Nordiques, Tony Twists former team. According to the St. Louis Post-Dispatch, when asked by Twists lawyer at trial if he knew of Twist when he named the character, McFarlane stated that "he may have come across it in the sports pages." McFarlane testified that had he wanted to give a character name recognition, he would have picked a name other than Tony Twists. McFarlane told a St. Louis Circuit Court jury he would have come up with something such as "Wayneatelli Gretzkytello." McFarlane did acknowledge that he attaches the names of friends and others to his characters but insisted that he never bases his characters personas on real people.
