O'Brien is suing the university to recoup his $3 million salary. David Swank, former head of the NCAA Committee on Infractions, made the claim in legal documents filed in the Ohio Court of Claims. Ohio State fired O'Brien after he acknowledged giving $6,000 to the mother of a Serbian recruit in 1999. Swank's statements rebut an NCAA allegation that O'Brien broke its rules by giving the mother of recruit Aleksandar Radojevic the loan. Swank, who was head of the NCAA infractions committee from 1992 to 1999, contends that Radojevic was a professional athlete and not a recruit when O'Brien made the loan.

Franklin County Common Pleas Judge Alan C. Travis threw out the lawsuit Monday, saying state law requires any contract that extends beyond one year to be in writing. Former Ohio State athletic director Andy Geiger fired O'Brien last June 8 after the coach admitted giving $6,000 to Aleksandar Radojevic, a recruit who never played for the Buckeyes. The payment, an NCAA violation, came to light in Salyers' lawsuit. Salyers said in the suit that former Ohio State boosters Dan and Kim Roslovic agreed to pay her $1,000 a month plus expenses for letting former Buckeyes guard Boban Savovic live with her. The now-divorced Roslovics, who employed Salyers as a housekeeper and baby sitter, had denied there was ever an agreement for her to take in and care for Savovic. He came to the United States from war torn Yugoslavia and played on Ohio State's 1998-99 Final Four team.

If there's one head coach who has been considered Mr. Integrity over his 28 years of coaching from being an assistant at Connecticut to his head-coaching stints at St. Bonaventure, Boston College and Ohio State it's O'Brien. Jim O'Brien coached Ohio State to the 1999 Final Four, where the Buckeyes lost to eventual national champion Connecticut. During those 28 years, there has never been a hint of impropriety. Anyone who knows him feels that he's as honest as they come. He's a class guy in the coaching fraternity, and that's why I was shocked to hear of his dismissal. I was even more surprised when I heard the reason that he admitted he gave $6,000 to a youngster from overseas in the recruiting process. It blows my mind. You can't condone the fact that he gave the player's family that money, no matter what the reason. While it may have been a humanitarian gesture, it was wrong. He violated the rules, his trust and his contract. A punishment for those actions was necessary.

Ohio State President Karen Holbrook said the firing of OBrien on June 8 was the first step in appeasing NCAA investigators. She and Geiger said more penalties may be coming. OBrien, who had coached the Buckeyes for seven seasons, was fired six weeks after he spoke with Geiger about the payment. During their conversation, Geiger said OBrien admitted he gave $6,000 to recruit Aleksandar Radojevic in 1999. Radojevic never played for Ohio State. He was deemed ineligible by the NCAA before he enrolled because he had accepted money to play basketball in his native Yugoslavia.
